How It Works

1

Tell Us the Basics

Enter the company name, product or service category, and the date range of your NDA. Then choose which types of disclosures you want the right to make.

2

We Generate Your Letter

Our system produces a formal Phase 1 demand letter using your information. You review, authorize, and send it yourself — directly to the company.

3

Track & Escalate

We track the company's response. If they refuse, the request escalates from your personal demand letter to an organizational advocacy letter sent by MSIH on your behalf.

Why This Works

Public Policy Limits on NDAs

Courts have consistently held that NDAs cannot be used to suppress evidence of illegal conduct, safety hazards, or matters of significant public concern. A demand for modification on these grounds is legally recognized.

The Two Phases

Phase 1 — Your Demand Letter

We generate your letter — you review, authorize, and send it yourself, directly to the company.

Phase 2 — Advocacy Letter

If no response, MSIH sends an organizational letter on its own letterhead referencing its regulatory relationships.

The Letter You Send

This is a sample of the Phase 1 demand letter generated from your intake. The orange fields are filled with your information. You choose which disclosures to request — those become the attached exhibits. You review, authorize, and send the letter yourself.

Phase 1 — Your Demand Letter (Sample) Example Only
[Date] {{CompanyName}} Legal Department / Compliance Officer Re: Request to Modify Non-Disclosure Agreement Consumer: {{ConsumerName}} Product / Service: {{ProductCategory}} Agreement Year / Period: {{DateRange}} Dear Sir or Madam, I am writing to formally request modification of the non-disclosure agreement ("Agreement") I signed in connection with {{ProductCategory}} provided by {{CompanyName}}. It is well-established that non-disclosure agreements may not be enforced where they suppress information related to unlawful conduct, consumer safety hazards, or matters of significant public interest. Courts and legislators across the United States have increasingly recognized that blanket NDAs used to silence consumers are contrary to public policy. I hereby request that {{CompanyName}} agree in writing to release me from the confidentiality obligations that restrict the disclosures listed in the attached exhibits, which I have selected based on my situation: {{SelectedExhibits}} Please respond in writing within 30 days of the date of this letter. Failure to respond will be treated as a refusal and this matter will be escalated accordingly. Sincerely, {{ConsumerName}} — — — Exhibits — — — Exhibit A-1 Consumer review (share your experience publicly) Exhibit A-2 Regulatory complaint (CFPB, FTC, or state AG) Exhibit A-3 Media statement (speak to journalists or media) Exhibit A-4 Attorney referral (discuss with another attorney) Exhibit A-5 Social media (post about your experience) Your letter includes only the exhibits you select during intake.
