Pre-Filing Steps

Read the arbitration clause, send a written notice of dispute, calculate damages, and identify your legal claims.

Pre-Filing Steps

  1. Read the arbitration clause word-for-word. Identify: arbitrator forum, filing fee, notice requirement, informal-dispute window, venue, governing law.
  2. Send a written notice of dispute if the clause requires it (many do — 30 or 60 day cure period). Send by certified mail + email. Keep the green card and tracking.
  3. Calculate your damages. Itemize every dollar. Attach receipts.
  4. Identify your legal claims. Breach of contract, fraud, state consumer protection act (UDAP), warranty, FDCPA, TCPA, etc.
  5. Check the statute of limitations. Do not let it run.
  6. Decide on counsel. Many consumer attorneys take arbitration cases on contingency or fee-shifting. Fee-shifting statutes (UDAP, FDCPA, TCPA) often pay attorney fees separately.
